Upsite Systems Terms and Conditions

1. About the Services

Upsite’s Services currently include:

Foresight – data analytics and insights for state-level incentives and economic decision-making

Compass – location intelligence and comparison tools to evaluate states and incentives

These Services may evolve, and additional products may be added in the future. All Services are governed by these Terms.

All outputs and insights provided through the Services are for informational purposes only and do not constitute legal, tax, financial, or investment advice.

2. Eligibility

To use the Services, you must:

Have the legal authority to enter into these Terms on behalf of yourself or your organization

By using the Services, you represent and warrant that you meet these requirements.

3. Account Registration

6. Data Sources & Accuracy

The Services use data from public sources, third parties, and Upsite’s proprietary databases.

While we strive for high-quality data and accurate modeling:

Incentive availability, terms, and eligibility can change

You bear responsibility for verifying data before making decisions

7. Fees and Payments (If Applicable)

If access to any part of the Service requires payment:

You agree to pay all fees as disclosed at the time of purchase

Upsite may modify pricing with advance notice

Unpaid balances may result in suspension or termination.

UPSITE’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO UPSITE IN THE 12 MONTHS PRIOR TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Upsite and its affiliates from any claims, losses, liabilities, and expenses arising from:
